In the UK, under British law (the Act of Settlement and a law passed during the reign of George I), custody of the minor children does not belong to the parents (this largely applies to the male heirs).This is why the divorces of Charles and Andrew did not include custody arrangements for their children. Legally, the sovereign is the guardian. Charles and Diana and Andrew and Sarah needed permission to take their children out of the country.
