Annoraks: A delusion is commonly defined as a fixed false belief and is used in everyday language to describe a belief that is either false, fanciful or derived from deception. ...
Sterling: "Delusion" to me seems more like a medical condition, whereas "deception" seems more like a criminal condition.
So in this case, does the delusion flow from deception (as the definition suggests, or does the deception flow from delusion?
Delusion in fact could probably a defence against the crime of deception.
Therefore, if for instance you had an honest belief that you were the owner and operator of an offshore radio station (delusion) and you entered into contracts on that basis, the contract would probably be void. It would be a representation but for the representor's delusion.
